Terms of Service

1. Booking Retainer / Deposit
A non-refundable booking retainer is required to reserve the event date. It is applied toward the package balance. The date is not held until the retainer is received and confirmed. The remaining balance is due no later than 7 days before the event. Failure to pay by the due date may result in forfeiture of services without refund of the retainer.
2. Rescheduling
One date change may be requested at no additional charge when written notice is received at least 60 days before the original event and the new date is available. Requests made within 60 days are subject to a $150 rescheduling fee. Availability for a new date is not guaranteed.
3. Cancellation Policy
Cancellations must be submitted in writing by email. The booking retainer is non-refundable. A cancellation more than 60 days before the event forfeits the retainer. A cancellation within 60 days forfeits the full amount paid to date. If New Diamond Productions must cancel for a circumstance within its control, amounts paid will be refunded.
4. Final Payment and Postproduction
The full remaining balance must be paid before postproduction begins. No footage or photographs will be culled, edited, color corrected, mixed, assembled, or otherwise worked on while a service balance remains unpaid. Media will be retained according to normal production procedures, and the estimated delivery timeline begins only after the event has occurred and the final balance has cleared.
5. Delivery Timeline
The standard delivery timeline is 6 to 8 weeks for edited films and 4 to 6 weeks for photography galleries. Rush delivery may be available as an add-on. Conditions outside our control may affect delivery, and New Diamond Productions will communicate when a delay is anticipated.
6. Client Responsibilities
The client is responsible for accurate event details, vendor coordination, required venue permissions, and safe and reasonable access for the production team. New Diamond Productions is not responsible for moments missed because of inaccurate schedules or restricted access.
7. Laser Lighting Is Prohibited
DJ, venue, and entertainment laser effects are not permitted while New Diamond Productions is providing photography or video coverage. A direct or reflected laser beam can permanently burn pixels or lines into a camera sensor in a fraction of a second, even when the effect appears safe to the eye. The client agrees to notify the DJ, venue, lighting company, and other vendors before the event and ensure all laser fixtures remain disabled. If lasers are activated, the production team may immediately pause, relocate, or end coverage to protect its equipment. New Diamond Productions is not responsible for moments missed while unsafe laser effects are operating.
8. Schedule Delays and Additional Coverage
Coverage is scheduled for the time included in the selected package. If the event runs behind and a dance, speech, ceremony, performance, or other important moment is still underway when scheduled coverage ends, the client authorizes New Diamond Productions to continue coverage when reasonably necessary to avoid abruptly missing that moment. Continued time is billed in 15-minute increments at the additional-coverage rate applicable to the booked service. The added charge becomes part of any unpaid balance or, when the booking was already paid in full, is issued as a separate invoice.
9. Usage Rights
After delivery and full payment, the client receives a personal-use license to delivered media. New Diamond Productions retains copyright and creative rights and may use edited portions for portfolio and promotional purposes unless a written restriction is requested before the event.
10. Force Majeure
New Diamond Productions is not liable for a failure to perform caused by circumstances beyond reasonable control, including natural disasters, severe weather, government action, civil unrest, or illness of key personnel. Reasonable efforts will be made to fulfill the agreement or arrange a qualified substitute.
11. Communication
Official booking communications should be directed to diego@ndpfilms.com. By submitting a booking, the client consents to booking and event communications by email and phone.
